Delhi Court reserves order in Delhi Speaker Goel’s trespass case to put additional documents on record

The Sessions Court has reserved order on Delhi Assembly Speaker Ram Niwas Goel’s plea to put on record additional documents in his appeal against the conviction in a trespass case.

Ajay Kumar Kuhar, Special CBI Judge cum Additional Session Judge, Rouse Avenue Court heard the matter wherein Goel was convicted under section 448 IPC for trespassing a house belonging to competing political party. Goel was sentenced imprisonment for six months with a fine amounting to Rs. 1000. He filed an appeal before the Sessions Court under Section 389 CrPC to set aside the sentence.

The Counsel appearing for Goel moved an application under section 391 Crpc praying before the court to produce additional documents regarding the trespassed property. It was alleged by the counsel that the complainant was not the actual owner of the property and hence, the requisite of the section 448 IPC does not meet.

The Counsel appearing for state has however objected to the application stating that appellant had every chance to put forward these contention in the trial court which they did not put there. Hence, the application is liable to be dismissed.

The judge after hearing both the sides put the matter on 18 January at 2 pm for further order on the application under section 391 CrPC.
