Delhi court summons man for issuing talaq notice from Dubai on wife’s complaint under DV Act

A Delhi court has summoned a person for issuing talaq notice through courier from Dubai, where he was currently working, to his wife staying in India. 

Metropolitan Magistrate Archita Garg (Mahila Court) of South East District Saket Court, while taking note of the specific allegations levelled against respondent no. 1/husband by the complainant, issued summons to the husband, directing him to remain present before the court on the next day of hearing.

The Judge further issued notice to the Protection Officer on September 2, directing him to file a Domestic Incident Report (DIR) in the matter under Section 12 of the Protection of Women from Domestic Violence Act, 2005.

As per the complainant, she got married to one Ahmad Saad Masroor on March 19, 2023 as per Muslim law and custom in the presence of friends, relatives and family members of both the parties. 

She said her husband abandoned her after a few months of marriage and she was presently staying with her parents in Delhi. 

The complaint filed at Sarita Vihar Police Station further said that the husband of the complainant did not even inform her before leaving. She recently filed a police complaint with CAW Cell Sriniwaspuri Delhi. 

She said the Investigation Officer at Sarita Vihar police station tried to call her husband on his WhatsApp number but he did not take the call and also did not respond to the WhatsApp message and instead, sent the complainant talaq notice, which was against the provisions of the Muslim Women Protection Act, 2019. 

The complainant sought registration of an FIR and legal action against her husband and in-laws as per law.

She said she was made a victim of gross physical, mental, emotional and verbal abuse by the respondents, including her husband (R1), his father (R2), mother (R3) and sister-in-law (R4).

As per the complainant, her husband and mother-in-law misbehaved with her on numerous occasions and abused her physically. She said her husband humiliated her by making adverse comments against her face and body. He refused to take her to Dubai and also asked for dowry.

Advocates M.F.Khan, P.K.Singh and B. Krishna appeared for the petitioner.
