Delhi HC issues notice to govt agencies on the use of pressure horns

A Delhi High Court division bench headed by Chief Justice Rajendra Menon sought replies from the Centre, Ministry of Home Affairs, Delhi government, Central Pollution Control Board and Delhi Commissioner of Police on a PIL seeking a ban on manufacture, sale and purchase of hazardous pressure horns, multi-toned horns, speakers/woofers, modified silencers on vehicles specially Enfield make bikes and other loud sound producing equipments.

During today’s hearing, the Advocate Harpreet Singh Hora appearing for the petitioners said to the bench that pressure horns have caused nuisance in and around Delhi University’s North Campus.

The bench asked the petitioner’s Advocate why the plea was put up before it when the judgment in the matter was already rendered by SC in the year 2005.

The Advocate vehemently argued that it is an observation but there is no binding direction and as these violations are taking place in Silence Zone, it calls for immediate attention and directions by the Delhi High Court.

He further argued that despite making complaints to the police, no action is taken on the same and despite filing hundreds of challans, no efforts have been made to remove the said hazardous equipments from the vehicles thereby allowing the vehicles to continue the said violation and cause annoyance to the citizens thereby depriving them of their fundamental and legal rights.

“The said equipments are manufactured, sold and purchased unregulated and unchecked in the market and serve no purpose but for creating nuisance and annoyance. The problem is with bikes/cars in general and for Enfield make bikes in specific when it comes to modified silencers,” the advocate said.
