Ghaziabad Development Authority case: Allahabad HC expresses displeasure at inaction by officials

The Allahabad High Court has expressed displeasure over non-action of officials responsible in the case of illegalities in the allotment of 135 plots of the Ghaziabad Development Authority.

The Division Bench of Chief Justice Rajesh Bindal and Justice J.J Munir heard the Public Interest Litigation filed by Rajendra Tyagi.

In this case, on December 19, 2017, noticing grave illegalities in allotment of 135 plots by the Ghaziabad Development Authority, the Court had issued various directions, including proper investigation of the criminal case.

The Court said,

Liberty was given to the petitioner to make appropriate application at any stage of the proceedings, if the proceedings were not going in the right direction or the investigation was lingering on. The matter could be considered for transfer of investigation to the Central Bureau of Investigation.

As transpired in Court, the investigation has still not been concluded in the last five years. Even an affidavit of its stage has not been filed.

The Court has granted one last opportunity to the Government Advocate to place complete facts before the Court.

The Court has fixed the next hearing of the petition on July 14, 2022.
