Judge shouting incident: Gujarat High Court directs YouTube to remove apology video of Justice Biren Vaishnav

The Gujarat High Court has instructed the online video sharing and social media platform YouTube to remove the videos of apology made by a senior Judge of the High Court for his outburst against his woman colleague on the Bench.

As per a media report, the High Court has directed YouTube to remove the apology videos of the judge claiming copyright violation.

On October 23, Justice Biren Vaishnav, currently the fourth senior most judge of the High Court, had passed an order on a batch of petitions related to tax in the open court.

Justice Mauna Bhatt, who was also part of the Bench, did not seem to agree with Justice Vaishnav and whispered something in his ear.

Justice Vaishnav, recalling that Justice Bhatt had differed in another matter also, said in a loud pitch that she was doing the same here.

Justice Bhatt said that it was not a matter of differing. However, Justice Vaishnav told her to pass a separate order and not to murmur.

The senior judge then rose and left the courtroom.

On October 25, as soon as the Bench assembled, Justice Vaishnav apologised to the lawyers present in the courtroom and also to Justice Bhatt.

Stating that what happened on Monday should not have happened, Justice Vishnav said that he was wrong. He further said that he was sorry for the incident.

As the Gujarat High Court live-streaming was in process, the video got in public view and was shared on social media.

The High Court has now pulled down the clip of that exchange from its archives.

Although the clips pertaining to exchange data of ideas has been taken away, but the apology by Justice Vaishnav is still available on the HC website, which the High court wants to be removed.

As per a media report, an official of the Gujarat High Court Registry confirmed that such notices were sent out.

After the YouTube communication, it was found that several websites had removed the video saying it was no longer available due to a ‘copyright’ claim by Gujarat High Court.
