Gyanvapi Mosque Committee submits application before Varanasi Court opposing plea by Hindu worshippers seeking ASI Survey of Mosque premises

The Gyanvapi Mosque Committee submitted an application before the Varanasi Court opposing the plea by the Hindu Worshippers for seeking ASI Survey of Mosque premises.

The Committee submitted that neither was the Mughal emperor Aurangzeb cruel, nor did he demolish any Lord Adi Vishweshwar Temple in Varanasi.

The Anjuman Intezamia Masjid Committee in its objection to the ASI Survey of the premises, has denied the allegation made in the plea by Hindu Worshippers that old Lord Adi Vishweshwar Temple temple was attacked and destroyed by a Muslim invader and Raja Tondal Mal restored the temple at the same place in 1580 AD.

The application also ads another point that there was no concept of two Kashi Vishwanath temples (old and new) in Varanasi.

The objections by the committee also objects to the plea by Hindu worshippers’ plea calling Muslim rulers as invaders.

It adds that the said allegation was made with the aim of creating hatred among Hindu Muslims.

The application states that the structure which is the Gyanvapi Masjid today, has there for thousands of years, and it was a mosque ever since.

The application further adds that the Muslims of Varanasi and neighbouring districts, have been offering Namaz Panjgana and Namaz Zuma and Namaz Idaan.

The Masjid Committee stated that contrary to the claims of the Hindu Worshippers, no Shiva Linga was found last year inside the Gyanvapi Mosque premises and the object that is being claimed to be a Shiva Linga, is actually a Fauvara (Fountain).

The application by the committee prays for rejection of the Hindu Worshipers’ plea seeking an ASI survey of the Mosque premises.

The plea states that the ASI can’t be ordered to survey the premises as the photographs are clearly showing that the disputed site is a Mosque.

The applicant adds that it is not permissible under the Law that evidence is made to be collected by a commission or by way of a scientific probe.

The application puts a very important point that a suit is pending in the court of Civil Judge (C.D.) FT C, Varanasi,in the disputed land case since April 2021 AD after the order was passed for ASI to conduct a survey.

The application states that a writ plea was moved before the Allahabad HC against the order which is under consideration and on which both the above writs have been reserved for orders after the completion of arguments by the parties and hence, the application prays that in such a situation, the question of getting the survey done by the ASI on the same points again in respect of the same property does not arise.

A Varanasi Court has permitted an application that was put before it seeking to consolidate eight Gyanvapi-related suits pending before various courts.

The Court has agreed that all these matters will be heard together by the district judge’s court.

District Judge Ajaya Krishna Vishvesha passed this order today observing that all the matters should be tried together and consolidated together.

The Justice said that he believes that consolidating all applications will be expedient in the interest of justice that all the suits mentioned before the Court.
