Jammu and Kashmir HC orders full-term passport for doctor

The Jammu and Kashmir High Court has ordered the authority concerned to issue a full-term passport to a man, who had been denied it because his name matched that of a terrorist of the Jammu and Kashmir Liberation Front (JKLF) because of a muddled verification by police.

The petitioner is a doctor by profession, who was denied a full-term passport multiple times due to the muddled verification by the CID.

The petitioner said the respondent department had made a wrong entry in their register with regards to the petitioner and the petitioner was only issued a STP (Short Term Passport) of 2 years in 2016 and 3 years in 2018. The petitioner contended that there are no doubts with regards to the predecessors yet he was issued a short-term passport.

It was also stated that during re-verification by one of the respondent departments through SSP CID SB Kashmir, it was revealed that another person having the same particulars as that of petitioner revealed to be a Pakistan-trained released militant of the JKLF whose records have been with the CID. The petitioner, on the other hand, is a doctor who has never been involved in militancy.

After hearing the petitioner, Justice Rajnesh Oswal observed that though there was the denial by the respondent department at the earlier stages, the matter got verified later. From the perusal of the record, it was evident that the claim of the petitioner for issuance of a full-term passport has been substantiated by the CID in unequivocal terms. That the petitioner was never involved in militancy and rather it is another person with same particulars, who has remained involved in militancy.
