Karnataka High Court directs BBMP to decide on removing encroachment in Jayanagar

The Karnataka High Court has directed the Bruhat Bengaluru Mahanagara Palike (BBMP) to consider and decide the representation of the petitioner regarding encroachment on a road by a private respondent in Jayanagar, Bengaluru.

The Division Bench of Chief Justice Prasanna B. Varale and Justice M.G.S. Kamal disposed of a Public Interest Litigation (PIL) seeking a direction to respondent authorities to take appropriate legal action to remove the encroachment put up by the private respondent on a road in Jayanagar, Bengaluru, as the same is impeding vehicular movement.

The counsel for the petitioner submits that though the petitioner has given representations to the BBMP and the Commissioner of the Department of Muzarai and Endowment requesting to take action for removal of the encroachment, no decision has been taken on the said representations till date and as such, the petitioner was left with no other option but to approach the Court by filing the petition.

The counsel for the BBMP submitted that if some reasonable time is granted, the BBMP would consider and decide the representation filed by the petitioner.

“Accepting the statement made by the learned counsel for the BBMP as an undertaking to this Court, we dispose of the writ petition with a direction to the BBMP to consider and decide the representation of the petitioner dated 21.03.2022 as expeditiously as possible, but not later than 10 weeks from the date of receipt of a copy of this order. We also direct the BBMP to communicate the decision so taken to the petitioner within two weeks thereafter,” the order reads.
