Karnataka High Court dismisses PIL as averments made are vague in nature

The Karnataka High Court dismissed a Public Interest Litigation filed seeking direction to the Secretary, Home Department, Government of India as well as Director of Central Bureau of Investigation (CBI) to decide the representation of the Petitioner with regard to independence of Central Bureau of Investigation.

The Petition filed by one Gurunath Vadde who is a resident of Bidar submitted a representation dated 08.04.2022.

From the perusal of aforesaid representations ,the Division Bench of Acting Chief Justice Alok Aradhe and Justice S. Vishwajith Shettyit observed that in the PIL it has been averred that the Chief Justice of India has stressed the need for the CBI to be independent.

The averments made in the petition are vague and the statement of the Chief Justice of India alleged to be made is based on a news item , the Court held.

“The averments made in the writ petition are vague and no factual foundation for submission of representations has been laid down in the petition. There is no material on record to show that representations submitted by the petitioner had been received by the respondents,” with the above observation the Bench dismissed the PIL .
