Madhya Pradesh HC disposes of petition seeking night shifts for training nurses

The Petitioner further prayed to update the online portal on that behalf providing for an option of night shift for the clinical training programme.

The Madhya Pradesh High Court has observed that the Madhya Pradesh Nurses Registration Council, Bhopal also included provision for night shift for the training of nurses in nursing institutes and took a decision with promptitude.

The Gwalior Bench of Justice Rohit Arya made this observation while disposing of a petition filed by the Private College Nurse Association through its Secretary seeking relief in the form of direction to respondents to implement the night shift for the training of nurses in nursing institutes in affiliated nursing homes/hospitals in the State of Madhya Pradesh.

The petitioner further prayed to update the online portal on that behalf providing for an option of night shift for the clinical training programme.

The High Court was of the view that relief so claimed for is in fact a matter of policy to be addressed by the Madhya Pradesh Nurses Registration Council, Bhopal. Therefore, it shall, in the fitness of things, appropriate for the petitioner to seek an audience of the Council in the context of reliefs claimed, the Court held.

The Court cannot superimpose its decision upon the Council, as the same shall require consideration of various factors before providing for night shift training as sought for.

“In view of aforesaid, this Court declines to invoke jurisdiction under Article 226 of the Constitution of India. However, it is apposite to observe that in case the petitioner approaches the Council, the Council shall, upon due adherence to the guiding principles, which, according to learned counsel for the petitioner, also include provision for night shift, take a decision with promptitude. With the aforesaid, writ petition stands disposed of,”
