Madras High Court to hear Habeas Corpus plea filed by wife of Tamil Nadu Minister Senthil Balaji against ED

The High Court of Madras on Tuesday listed the Habeas Corpus petition filed against the Enforcement Directorate (ED) by S. Megala, wife of Tamil Nadu Minister for Electricity, Prohibition and Excise V. Senthil Balaji, for afternoon.

The matter was mentioned before the Division Bench of Justice M. Sundar and Justice R. Sakthivel by Senior Advocate N.R. Elango, contending that ED had arrested Balaji under the Prevention of Money Laundering Act (PMLA) without any prior issuance of summons or notice.

The Bench directed the petitioner to get a number assigned for the case and bring it before the bench again at 1:30 P.M.

The petitioner filed a Habeas Corpus petition under Article 226 of the Constitution alleging unlawful detention of her husband by the Enforcement Directorate without any prior notice in a money laundering case. 

Balaji was arrested on Tuesday after the ED initiated questioning in a case registered against him for offences allegedly committed by him during his tenure as the Transport Minister during the government of All India Anna Dravida Munnetra Kazkhagam (AIADMK) from 2011-2015.  

The Enforcement Directorate resumed the probe into the matter after the Supreme Court order dated June 16. The Apex Court reversed the decision of the Madras High Court that guided the police officials of the state to commence fresh investigation in the matter, and permitted ED to continue the ongoing probe.
