Madras High Court disposes of petition seeking enquiry, action against racial discrimination in Kodaikanal school

The Madras High Court disposed of a Petition filed seeking direction to the Respondent No.2 (The Government of Tamil Nadu) to conduct enquiry and take action for the racial discrimination in the school and consequently to take over the management of one School, Kodaikanal, Dindigul District, within the time period stipulated by the Court.

The counsel for the petitioner submits that the representation was given by the petitioner against the respondent No.6(School) for the racial discrimination. The complaint was filed by the son of the petitioner who was thrown out of the school.

The complaint was given against the Principal of the school that he was targeting the students. The complaint was given regarding quality of food and humiliation meted out.

Advocate for respondent No.6 submits that the Principal even at the time of filing of the petition was not the Principal of respondent No.6 school and he was transferred to some other school.

It is further submitted that the said Principal went abroad and he is not the Principal of respondent No.6 school. The school is more than 120 years old. No illegal practices are being performed.

The petition was filed in the year 2014. It is contended by the counsel for respondent No.6 that the said Principal was already transferred before the petition was filed to some other school and he is not in the respondent No.6 school. The son of the petitioner also finished his studies in the respondent No.6 school , the Division Bench of Chief Justice Sanjay V. Gangapurwala and Justice K.K. Ramakrishnan observed.
