NGT dismisses petition praying review action towards implementation of compensatory plantation work

The National Green Tribunal (NGT) dismissed a Petition filed praying to review the action undertaken by the respondents towards implementation of compensatory plantation work, as per terms of State Level Environment Impact Assessment Authority (SEIAA) consent for construction of National Highway’s in question.

The Petition filed by one Sunil Mishra further prayed to submit a comprehensive report on the total loss of trees during the widening work of National Highways in question and the details of compensatory plantation so far undertaken in order to compensate for loss of green cover.

The Central Bench of Justice Sheo Kumar Singh and Dr. Afroz Ahmad noted that the main cause for filing this application is simply calling information from the Respondent with regard to the plantation and maintenance and security of the trees planted by the National Highway Authority.

The application was previously moved before the Competent Authority Divisional Manager of MPRDC Shahdol and the information has been provided with regard to the total plantation as 25000 and surviving plants 24427. The Similar reply has been issued vide letter dated 08.01.2019 dated 01.12.2020 and on the question under RTI dated 21.02.2023. In this way the information has been submitted by the authorities concerned.

“Review of the action of the respondent or the calling of a report from the National Highway Authority is not the domain of the National Green Tribunal. This is purely administrative purview. Nothing has been shown by the applicant with regard to the violation of any rules”, observed by the NGT.
