Allahabad HC directs action against police officers accused of paddy-wheat purchase scam, defaulting

The Court directed the Additional Advocate General to look into the matter so that corrective action is taken immediately.

The Allahabad High Court has directed to take immediate action against the Police officers, including the officers accused of the Paddy-Wheat purchase scam in Chandauli since 2011, who filed the charge sheet without producing them in the Court.

The division bench of Acting Chief Justice Munishwar Nath Bhandari and Justice Ajai Tyagi passed this order while hearing a PIL filed by Om Prakash Gupta.

The Court observed, “Pursuant to the direction of the Court, instruction sent to the Additional Advocate General has been produced. It shows that in two cases an interim order has been passed by the Court, while in other cases no interim order exists available in favour of the accused and they have been served with notice under Section 41(a) Cr.P.C. The charge-sheet was, however, produced in the Court without production of the accused”.

The Court directed the Additional Advocate General to look into the matter so that corrective action is taken immediately. It may not only in reference to the accused, but the police officers defaulted in carrying out appropriate action, after notice under Section 41(a) Cr.P.C.

Santosh Kumar Mishra, Counsel for the State argued the Petition. He said that with the connivance of Chandauli officials and mill owners, minor purchases are being made from farmers and most of the purchases are being done through middlemen. When the Petitioner raised his voice against corruption, an FIR was lodged against him in Varanasi Cantt police station for obstructing government work.

The complaint of the Petitioner was investigated in which the charge sheet has been filed but the accused officers have not been arrested by the police and presented in the Court. The Court gave relief in only two cases but still no action is being taken by the Police in other cases.

The Court has fixed the next hearing of the Petition on August 05, 2021.
