Punjab High Court disposes of PIL seeking action against private respondent for manipulating his service record

The Punjab High Court imposed a costs of Rs.10,000/- on the Petitioner and disposed of a Public Interest Litigation (PIL) filed seeking direction to the  Additional Chief Secretary to Govt. of Haryana, Cooperation Department, Chandigarh (respondent No.2) to decide representation dated 16.08.2023  filed by the petitioner for taking action against private respondent (respondent No.4) for manipulating his service record by mentioning his home town as Delhi whereas he is a permanent resident of District Sonepat.

Status report filed by Joint Registrar (Administration), Office of Registrar Cooperative Societies, Haryana, Panchkula on behalf of respondent No.3  is taken on record by the High Court.

It is submitted that application made by respondent No.4 on 01.02.2021 for change of permanent address from Sonepat to Delhi has been allowed on 05.07.2021 and as per Government of India instructions, change of home town shall not be made more than once during the service of Government servant.

Since at present the permanent address of respondent No.4 is of Delhi and he is presently posted at Jind, no cause of action survives in this petition and the same is dismissed with costs of Rs.10,000/- to be deposited by the petitioner with the High Court Legal Services Authority , the Division Bench of Acting Chief Justice Ritu Bahri and Justice Nidhi Gupta ordered.

The PIL has been filed by one Harpal Singh Mor.
