Rajasthan High Court dismisses PIL lacking supportive documents, facts

The Rajasthan High Court has dismissed a PIL, while observing that a citizen approaching the court in public interest holds a greater duty to make full research and present necessary facts before the Court to cause further investigation.

The Division Bench of Chief Justice Akil Kureshi and Justice Rekha Borana disposed of a PIL, alleging mis-management in the Cooperative Society.

In this public interest petition, the Bench found that there were no supporting documents or informative evidence, even prima facie sustaining serious allegations made by the petitioners with respect to mis-management of the Cooperative Society.

In the present format, the Court was not inclined to entertain this petition. “A citizen approaching the Court in a public interest jurisdiction holds a greater duty to make full research and present necessary facts before the Court to cause further investigation,” it observed.

The Court disposed of the PIL. However, it directed that if the petitioners were able to place further material on record, it would be open for them to file a fresh public interest petition.
