Rajasthan High Court disposes of PIL on NH158 with direction to NHAI to consider villagers’ grievance

The Rajasthan High Court has recently disposed of a Public Interest Litigation (PIL) alleging that the respondent National Highways Authority of India is constructing the National Highway 158 passing through Tehsil Aasind in such a manner which is prejudicial to the interest of villagers, with risky curves for moving traffic and displacing land of a government school.

The PIL had been filed by the residents of Gram Mod Ka Nimbaheda. Before approaching the High  Court, the petitioners claimed to have filed a detailed representation to the General Manager, National Highways Authority of India on 1.1.2022 through a registered post. The petitioners alleged that no response has been given to such representation.

In view of the peculiar facts of the case, the Division Bench of Justice Sandeep Mehta and Justice Vinod Kumar Bharwani directed the petitioners to submit the representation along with the copy of this order to the General Manager, National Highways Authority of India, who shall objectively consider such representation within a month from the date of submission thereof. With the above observations, the writ petition is disposed of.
