Review cadre restructuring of ITBP, Delhi HC tells Centre

New Delhi: The Delhi High Court has directed the central government to review its cadre restructuring of the Indo-Tibetan Border Police Force. The direction has been made with regard to the ITBP’s General Duty Cadre and Non-General Duty Cadre.

A divisional bench comprising Justice Rajiv Sahai Endlaw and Justice Asha Menon noted that the said review will not suspend or hinder any other ongoing or completed cadre review.

 The petition has been filed challenging the ITBP cadre restructuring review and has sought direction for the central government to conduct a holistic cadre review considering the promotional avenues in Education and Stress Counselor Cadre to overcome stagnation.

The bench has also directed the center to give reasoning on the decision of rejecting the claims of the petitioners made at the time of the personal hearing.

The bench referred to a 2015 judgment of the Delhi High Court in Ajay Suryavanshi vs. Union of India where the bench had directed the respondents to carry out cadre review exercise, considering the concerns expressed in the judgment and the data provided by the petitioners therein and keeping in mind the salient features as laid down in the said judgment.
