SC dismisses Plea Challenging Appointment of Justice Prasad as Madras HC Judge

A three-member Supreme Court bench headed by Chief Justice Ranjan Gogoi and comprising Justices S K Kaul and K M Joseph on Monday dismissed a petition challenging the elevation of Justice Subramaniam Prasad as an Additional judge of the Madras High Court earlier this year.

The writ petition, by way of public interest, was by an advocate M Radhakrishnan against the judgement of the High Court in June this year which stated that Justice Prasad had not practiced in the Madras High Court or any other subordinate court for a period of ten years. It sought to declare the appointment as null and void. At the very inception, the petitioner, appearing in person, has stated that he has no objection to the writ petition being taken up by this Bench presided by the Chief Justice, since the decision to recommend the third respondent for elevation as Judge was taken by a Collegium of which the present Chief Justice was not party and long before the present Chief Justice assumed office as a Judge of this Court.

Today, CJI asked the petitioner appearing in person on what grounds he is challenging the appointment of the judge.

The court not bound to interfere in any matter related to the writ petition hence matter dismissed accordingly.
