Uttarakhand HC directs Haridwar SDM to complete proceedings in 6 months

The Uttarakhand High Court recently directed the SDM/Assistant Collector, Haridwar to complete the proceedings under Section 122 of the UP Zamindari Abolition and Land Reforms Act, 1950 by adopting the due procedure established by law within six months.

The Division Bench of Acting Chief Justice S.K. Mishra and Justice Alok Kumar Verma disposed of a PIL filed by Isam Singh and other.

The PIL seeks direction to the state to remove illegal construction and encroachment from land situated at village Tanshi Pur, Pargana Bhagwanpur Tehsil Roorkee, District Haridwar.

A counter-affidavit has been filed by the State of Uttarakhand, wherein it is admitted that actually three persons have encroached upon the Government land, and for that purpose, they have already initiated proceedings under Section 122 of the UP Zamindari Abolition and Land Reforms Act, 1950.

In that view of the of the matter, the Bench disposed of the PIL by directing the SDM/Assistant Collector, Haridwar to complete the proceedings by adopting the due procedure established by the law within a period of six months.
