Supreme Court finds NLU run by contractual teaching staff as unacceptable

The Supreme Court has disapproved the practice by the National Law University, Nodhpur, of being managed by contractual teaching staff only. The Supreme Court termed the situation as unacceptable and undesirable.

The Apex Court found out that the National Law University, Jodhpur was not having a Vice Chancellor and the Registrar was contractual too.

The bench comprising of Justice Sanjay Kishan Kaul and Justice Sudhanshu Dhulia said the situation should be sorted by the institute itself and court should instead of court being called upon to do so.

The court was hearing an appeal filed by the National Law University, Jodhpur challenging the judgement of the Rajasthan High Court which struck down regulations for contractual employment of teachers.

The bench said that it was a matter of great concern that a National Law University, which are institutions in forefront of legal education should operate only with contractual teachers.

The bench was, however, told that now there have been some amendment to the regulations which provide for 50 per cent permanent staff and 50 per cent contractual.

The bench pointed out that as per the University Grants Commission Regulations, it should be only 10 per cent contractual staff.

Senior counsel Dhruv Mehta for the institution contended that they are not aided institutions.

The bench stated that NLU is an institutions of excellence and is but there is constant inflow and outflow of teaching staff because they are contractual in character which questions its standing. The bench said it was time to remedy the position

The bench also added that an educational institution should find remedy for the position itself rather than we being called upon to remedy the position.

Mehta sought a short accommodation to appropriately advise the clients.

The court scheduled the matter for directions on October 31, 2023. Advocate Rishabh Sancheti and Manoj Ranjan Sinha among others appeared for contractual teaching staff.
