Talaq-e-Hasan: Delhi High Court tells petitioner to join proceedings in Supreme Court

The Delhi High Court on Thursday granted liberty to the petitioner in a case related to Talaq-e-Hasan, to join the proceedings before the Supreme Court in a similar matter.

A Single-Judge Bench of Justice Yashwant Varma told petitioner Razia Naz that a similar matter was listed before the Supreme Court.

“You can join the proceedings there,” said the High Court.

While replying to Razia’s Counsels Mohan S and Shubham Jha, who said that the petitioners were different in both matters, Justice Varma opined that though the petitioners were different in both matters, but the issue was same.

The Court then fixed January 12 as the next date of hearing.

The petitioner sought direction to declare the Notice (divorce notice issued by her husband) void as it was Unilateral, Extra-Judicial Talaq, arbitrary, irrational and contrary to Articles 14, 15, 21, 25 and UN Convention on Human Civil Rights.

On June 22, the Single-Judge Vacation Bench of Justice Dinesh Kumar Sharma had issued notice on Razia’s petition.

The petitioner had challenged the June 2 notice served by her husband Shahenshah Alam Khan.

Razia had contended in her petition that she was married to Shahenshah Alam Khan, a resident of Panaji, Goa.

It was alleged that the petitioner was subjected to physical and mental torture at her matrimonial home as well as at her parental home, as their demand for expensive gifts was refused by the petitioner and her family.
