Court Says Judges’ Recruitment Cannot Be Advertised Publicly; Asks Petitioner To Read NJAC Judgement

A lawyer filed a petition, requesting that recruitment for judges should be advertised publicly as those who want to apply for the same can be made aware about the dates and procedures.

His argument was that, only senior lawyers’ sons and rich upper caste people are the ones who become judges in India. Further, the petitioner argued that lawyers from smaller courts don’t get the opportunity to apply for the position of judge.

Hearing this petition, Justice Khehar said that those lawyers who have no idea about working of High Court cannot be picked for the post of Judge. Besides, justifying the existing procedure, Justice Khehar said that he himself doesn’t belong to any upper caste, is not son or brother of a famous judge or lawyer as he is a farmers’ son.

The Judge asked the petitioner to file a curative petition against NJAC Judgement; and also asked him to read that historical judgement for more clarity.

Petition was dismissed.
