The curious land acquisition matter on section 24(2), on which one bench overturned another similar strength bench’s judgment, holding it per incuriam (ignores a contradictory statute or binding authority, and is therefore wrongly decided and of no force), was mentioned before a Supreme Court vacation bench on Monday (June 11).

The vase had been then referred to 9-judge bench for judgment and the matter is under review.

During mentioning a stay on review was prayed for. The bench said: “We cannot entertain review. You had sufficient time. List this matter in first week of July after vacations.”
