Allahabad High Court directs authorities to remove encroachment of the pond, land in Village Dhrehari, Allahabad

The Allahabad High Court has directed the completion of proceedings under Section 67 of the Revenue Code for removal of encroachment from a pond land located in Village Dhrehari, Asepur, Dhudehri, Saidabad, Allahabad within six months.

A single-judge bench of Justice Rajiv Joshi passed this order while hearing a petition filed by Deepak @ Deepak Yadav.

The petitioner’s counsel contention that Triloki Nath, Bhola Nath, Dayashankar, Nagendra Kumar, Amarjeet, Mahendra Kumar and Raj Kumar have encroached upon the pond and public utility land over Khasra area 0.5710 hectare in Village Dhrehari, Asepur, Dhudehri, Saidabad, Allahabad.

On instructions received by standing counsel, it is submitted that the removal of illegal encroachment proceedings against the persons who encroached the land in question has been initiated under Section 67 (1) of UP Revenue Code 2006.

In the facts and circumstances of the case, the court directed the respondent authorities to conclude the proceedings which are already initiated under Section 67 (1) of U.P. Revenue Code 2006 over Khasra No. 142 area 0.5710 hectare in the Village Dhrehari, Asepur, Dhudehri, Saidabad, Allahabad recorded as Talab in accordance with law expeditiously, preferably within a period of six months from the date of production of a certified copy of the order.

Accordingly, the Court disposed of the writ petition.

The petition had sought the following reliefs:

1. To issue a writ, order or direction in the nature of Mandamus directing/commanding the respondents authorities to move the encroachment over Talaab situated in Khasra No. 142 area 0.5710 hectare in the Village Dhrehari, asepur, Dhudehri, Saidabad, Allahabad which is Gaon Sabah Land.

2. To issue writ order or direction in the nature of mandamus to pass an order on the application sent by petitioner, Gram Pradhan and other villagers.
