Gujarat High Court directs Additional Government pleader to take instruction in installing windmill

The Gujarat High Court directed the  Additional Government Pleader (AGP) to take instruction in the matter of installation of the windmill in the area. 

The Division Bench of Chief Justice Sonia Gokani and Justice Sandeep N. Bhatt heard a Public Interest Litigation (PIL) filed by one Vinod Dhanjibhai Patel  challenging the question in the action and non action on the part of the respondent-authority.

This essentially concerns the permission granted by the authority for installation of the windmill in the area. The allotment of the land for the purpose of building the school for education of the children of the village since its resistance to the area already granted for the purpose of alternative source of energy, the petitioner is aggrieved.

   
Rajesh Gidiya, advocate for the petitioner has agreed that no school has so far come up. However, the permission has been granted and likely to come up in the future.

The Court had requested learned AGP to assist this cause by getting its know the possibility of noise pollution after once windmill is become operationalized. For the present, the work of installation is going nor is can be understandable, more particularly that presently is not our concerned the school has not yet come up.   

However, by way of long term effect not has been pressed is the report of “Environmental Noise Guidelines” of the World Health Organization which is of course meant for the European region , observed the High Court .


The order said copy of this order to serve the learned AGP who shall take the instructions and also get the expert’s opinion and place before this Court to enable this Court to appreciate this aspect better. Stand Over to 13th March, 2023″, the order reads.
