Litigants should not suffer on account of their inability to approach the Courts:- Karnataka High Court

The High Court of Karnataka at Bengaluru, made a special sitting at chief justice’s home office at 10 pm on Tuesday and disposed of the petition by issuing certain directions for preventing the spread of Corona Virus epidemic.

The petitioners namely “Mohammed Arif Jameel” and “Anoop K.T.” had filed the petition before the Hon’ble Mr. Justice Abhay Shreeniwas Oka, Chief Justice and Hon’ble Mr. Justice B.V. Nagarathna, High Court of Karnataka and the respondent in the aforesaid case was Union of India.

Brief facts of the matter is that the petition was filed with the prayer to issue certain directions in order to prevent the spread of Corona Virus Epidemic in the area and on the request made by the Hon’ble Judges, the Advocate General, State of Karnataka including Chief Secretary of the State was also present in the sitting and heard by the Hon’ble Judges.

The court after considering the appeal made by the Hon’ble Prime Minister of India and the Order of the Ministry of Home Affairs of the Central Government exercised the jurisdiction under Articles 226 and 227 of the Constitution of India to issue certain direction with a view that it ensure that citizens are not deprived of their right to approach the Courts of law including the suffering on account of inability to approach the Courts of law by the litigants.

Thereafter, the court extended the time period by one more month for all the interim orders including Bail orders passed by the criminal courts of the state of Karnataka, Karnataka High court, district courts and various tribunals which are due to be expired in the present month. Furthermore, the orders of eviction shall remain in abeyance for a period of one month from Tuesday. The court further requested the chairman of the Bar Council to circulate the order of the court to all the Bar Associations in the State.
