Manipur High Court disposes PIL setting aside order by the Chairman Manipur Legislative Assembly

The Manipur High Court disposed of a Public Interest Litigation (PIL) filed for setting aside the order dated 27.08.2022 passed by the Chairman (Hill Areas Committee) Manipur Legislative Assembly, thereby a Sub-Committee has been constituted under Rule 242(1) of the Rules of Procedure and Conduct of Business in Manipur Legislative Assembly for delimitation of Constituencies of the Autonomous District Councils, Manipur, consisting 9 (nine members).

The PIL is filed by one Simon Kamei .

It is stated that the Chairman of the Hill Areas Committee himself is the Chairman of the Sub-Committee.

The impugned notification is challenged for violation of Article 14, 19 and 371C of the Constitution of India and also it should be issued under the name of the Governor.

One Advocate, submitted a representation dated 16.09.2022 to the Governor of Manipur. The representation stated that the delimitation of the ADCs has to be done under the supervision of the Government and not by the Hill Areas Committee and SubCommittee was constituted by the Chairman, (HAC). It is submitted that the said representation is still pending.

Since the representation is pending before the Governor, the Division Bench of Acting Chief Justice MV Muralidaran and Justice A. Guneshwar Sharma is not inclined to pass any direction in the present PIL at this stage. However, liberty is granted to the petitioner by the High Court to make an appropriate representation to the competent authority/State Government within 2 (two) weeks’ time and the concerned authorities shall consider and dispose of the said representation, by issuing a speaking order within a period of 8 (eight) weeks from the date of receipt of the representation submitted by the petitioner, if any.
