Petition in Delhi High Court, wanting case to be registered against Mehbooba Mufti for insulting national flag

New Delhi (ILNS): A petition has been filed in the Delhi High Court against former Jammu and Kashmir Chief Minister Mehbooba Mufti, who made a controversial statement of not wanting to fly the tricolour.

Lawyer Vineet Jindal has filed the petition, saying that Mufti’s statement is an insult to the national flag.

“Mehbooba Mufti said that until the changes made in the Constitution on Jammu and Kashmir on August 5 last year were withdrawn, they have no interest in contesting elections or hoisting the tricolour,” read the Petition.

It also stated: “Because the statement made by the respondent no.4 (Mehbooba Mufti) that the ‘Dacoits snatched our flag’, in a way explicitly insulted India’s tri-colour… That she won’t take part in elections without the reinstatement of the Constitution and flag of the erstwhile state of J&K. She has hurt every law abiding citizen’s pride by this gross affront statement.

“Statement made by the respondent no.4 pointing the Indian Government that ‘dacoits snatched our flag’. In this statement, it is quite clear that she is using this derogatory and instigating statement against the duly elected Indian Government. It is an inciting statement which intends to create hatred and unrest among the communities and waging war against the duly elected government of this country as she is an influential and public personality,” claimed the Petitioner.

The Petition has demanded the registering of a case against Mufti for the offence u/s 4 of the Prevention of Insults to National Honour Act and U/s 121, 153, 153A, 295, 298, 504 & 505 of the I.P.C.
