Delhi High Court adjourns plea seeking records of Md Shahabuddin in Tihar jail and hospital where he died

Shahbuddin succumbed from complications stemming from COVID-19 on May 1, 2021 while undergoing treatment at Deen Dayal Upadhyay Hospital, Delhi from April 21.

The Delhi High Court on Wednesday adjourned a plea filed by Osama Shahab, son of former MP and Bahubali Mohammad Shahabuddin, seeking his father’s handwritten personal diaries, medical records and post-mortem report, along with CCCTV footage of the solitary ward in Tihar Jail where he was lodged and the hospital where he died, while receiving treatment for Covid-19.

A Single Judge Bench of Justice Rekha Palli adjourned the matter due to paucity of time.

Shahbuddin had succumbed to complications stemming from Covid-19 on May 1, 2021, while undergoing treatment at Deen Dayal Upadhyay Hospital, Delhi from April 21. He was shifted to Tihar Jail in 2017, owing to order of the Supreme Court in petitions filed by Siwan-based businessman Chandrakeshwar Prasad, whose three sons were killed in two separate incidents and Asha Ranjan, wife of journalist Rajdeo Ranjan, who was murdered in Siwan.

On the previous date of hearing, the court had issued notices to the Delhi Government and the Deen Dayal Upadhyay Hospital, Delhi and had directed them to file a status report, clearly stating as to why the petitioner’s requests are not being redressed expeditiously. Advocate Anuj Aggarwal, appearing for the respondents, had submitted that no adversarial view was being taken by the Respondents. The matter has been listed for hearing on December 6.
