Supreme Court grants bail to murder accused

The video and audio clips were submitted by the police in the high court in which the applicant can be seen convincing the deceased to eat the sweet halwa.

ILNS: The Supreme Court on Monday allowed bail to a person, accused of killing another by giving him prisoned halwa.

The accused had allegedly induced the other person to eat a halwa that the former had prepared, which was allegedly poisoned and this had been caught on camera.

In allowing bail, the Supreme Court overruled the Bombay High Court’s objection to it, by observing that “…the basic fact that who had prepared the CD (of the person coercing the other to eat the halwa) which is the main evidence used against the appellant and from which source it is recovered is not disclosed. In absence of the evidence, the chain of circumstances cannot be established. The appeal pending before the High Court be heard in accordance with this order.”

The Supreme Court said: “The High Court has muted the set of merit and the prosecution… succeeded in establishing the facts of the offence committed the applicant…”
