Telangana Police Recruitment Board to reconsider selection of a candidate having criminal antecedent; Telangana HC

Telangana High Court heard a matter pertaining to an individual who applied for the post of Driver in pursuant to the notification dated 31.05.2018 issued by Telangana State Level Police Recruitment Board, and qualified in the selection conducted in pursuant of the said notification. However, the petitioner is not deputed for induction training, which commenced on 17.01.2020. The Petition was heard by the bench of Justice P Naveen Rao.

The counsel appearing for the Petitioner contended that merely on the ground that he was shown as accused in a criminal proceeding wherein he was eventually acquitted cannot be denied for recruitment. The Petitioner supported the case with judgment. The Counsel appearing for the State contended that it not an automatic that merely because a person is acquitted of criminal charge, he should be recommended for employment and it is open for the respondent-Board to examine the nature of the charges and the manner in which acquittal was granted; having regard to the judgment rendered by the trail Court, the respondent has to take calling upon the explanation.

The court pursuant to the contention of the both the parties issued direction to the Respondent-Board to reconsider decision on the employment of the Petitioner and steps be taken within weeks after issuing the notice and considering the explanation tendered on behalf of the Petitioner.
