Former Ullu App legal advisor moves Mumbai Sessions Court, opposes country head, CEO anticipatory bail plea in sexual harassment case

Following the arrest of the business giant Raj Kundra in relation to creation of pornographic content, a similar platform, known for producing and releasing adult content viz. Ullu App, has landed into trouble. An FIR has been registered against its CEO and the Country Head, namely Vibhu Agarwal and Anjali Raina, respectively, at Amboli Police Station, Mumbai, by the former Legal Adviser of the Company

The former Legal Adviser of Ullu App, recently, moved Dindoshi Sessions Court, Mumbai, opposing the Anticipatory Bail application filed by the CEO and the Country Head of the platform in an alleged sexual harassment case.

Following the arrest of the business giant Raj Kundra in relation to creation of pornographic content, a similar platform, known for producing and releasing adult content viz. Ullu App, has landed into trouble. An FIR has been registered against its CEO and the Country Head, namely Vibhu Agarwal and Anjali Raina, respectively, at Amboli Police Station, Mumbai, by the former Legal Adviser of the Company under Sections 354 (Assault or criminal force to woman with intent to outrage her modesty), 354B (Assault or use of criminal force to woman with intent to disrobe her), 506 (criminal intimidation) and 34 (acts done by several persons in furtherance of common intention)of the Indian Penal Code.

Subsequently, Agarwal and Raina, moved the Trial Court for anticipatory bail. The matter will be taken up on August 21, 2021.

The victim has filed an Intervention Application through Advocate Satyam Singh Rajput, opposing the anticipatory bail applications filed by Agarwal and Raina. The application claims that several complaints has been filed against the said App and other platforms of similar nature, for the censorship of such obscene content produced and released by OTT Platforms, before the Madhya Pradesh High Court and the Supreme Court.

It further claims that an FIR has also been registered against the Director of ULLU Platform viz. Mr. Vibhu Agarwal and Ms. Megha Agarwal and other OTT Platforms for obscenity and indecent representation of women.

It is alleged that the victim has been framed in a false extortion case by Mr. Agarwal and Ms. Raina, as an attempt to pressurize her to not reveal any information against them. She was forced by Mr. Agarwal to watch adult/erotic content along with the editors; to act in the erotic and pornographic content of the said platform and to give seductive voice in the pornographic podcast of Lattu App, which is another app owned by Mr. Agarwal. Upon denying to all such demands, Mr. Agarwal and Ms. Raina invited her to office on June 18, 2021, on the pretext of solving all the issues, wherein she was informed about the case filed against her at Lucknow, and was  threatened with dire consequences if she failed to cooperate. Her phone was snatched and she was forcefully made to strip and wear sample inner garments which were to be launched by the Ullu Merchandise.

“They further took her photos and video and threatened her that they will make all the photos and video viral if she speaks about the incident with anyone or release any information regarding Pornographic apps,” the application adds.

It is further alleged that she was called to the office on June 18, 19 and 21 and was sexually and mentally harassed, and illegally confined in the name of investigation.

In light of the above, it is prayed that the Accused be demanded to submit CCTV footage of 18, 19 and 21 June, 2021; as also the Mobile phone of the victim.
