Uttar Pradesh gets Anil Kumar Mishra as the new Advocate General

The Governor of Uttar Pradesh Anandiben Patel has finally given her assent to the appointment of  Ajay Kumar Mishra as Advocate General of Uttar Pradesh.

The current Chief Secretary to Government of Uttar Pradesh Shri Durga Shankar Mishra on Saturday 14 May 2022, announced the appointment of Advocate Anil Mishra as the Advocate General of Uttar Pradesh.

In a cabinet decision, the Government of Uttar Pradesh approved the appointment of Ajay Kumar Mishra for the prestigious and important post of the new Advocate General of the state.

When it comes to the experience and legal acumens of the newly appointed AG, he started his legal profession in 1981 from Allahabad high court. He has been a practicing lawyer in Supreme Court since 2004.

The new AG after getting years of experience was appointed as Additional Advocate General of the State Government in High Court.

Advocate Mishra has been born in a distinguished lawyer family, his father was Late Justice SR Mishra who was a noted judge. Not only his father but his brother Justice Ashwani Kumar Mishra, is also a Judge in Allahabad high court.

After the incumbent AG Uttar Pradesh Raghvendra Singh resigned from his post about a month ago, the post of Advocate General was lying vacant.

A petition was filed in the Allahabad Court that talked of jurisdiction under Article 226   (this  empowers the high courts to issue, to any person or authority, including the government (in appropriate cases), directions, orders or writs, including writs in the nature of habeas corpus, mandamus, prohibition, quo warranto, certiorari or any of them

A division bench comprising of Justice DK Upadhyay and Justice Subhash Vidyarthi said : “We have already noticed that the office of Advocate General cannot be permitted to be left vacant.”

“Any vacuum in the office of a constitutional functionary may lead to very unsavoury situation and that would be completely impermissible not only having regard to the scheme of our constitution, but also bearing in mind various statutory functions which are to be performed by the Advocate General,” observed the court.

The resignation of the Former Advocate General was accepted and appointment of the newly formed Advocate General have been announced the the same order.
