A single-judge bench of Allahabad High Court while hearing an Appeal filed by Rama Nand dismissed the appeal saying that the Magistrate has the power to enforce an order of maintenance passed under Section 125 CrPC by issuing a warrant to the Collector to recover the same as arrears of land revenue.

“The Collector being the sole authority can take appropriate decisions considering the provisions of the policy”, the Court clarified.
