Allahabad High Court division bench while hearing a Criminal Misc Writ Petition filed by Shiv Prasad Gupta sought the Uttar Pradesh Government's response on the 'misuse' of Law while hearing a case wherein a show-cause notice had been served to a man under the Uttar Pradesh Control of Goondas Act, 1970.

The Supreme Court observed that guidelines issued by the Union have in no way made any genuine progress with regards to setting up halfway homes for those cured of mental illness as indicated by the State government and directed the Government to monitor the progress & apprise the court periodically.
