Supreme Court dismisses plea against its registry by Maharashtra judicial officer

The Supreme Court on Monday dismissed the plea filed by Maharashtra Judicial Magistrate Syedullah Khaleelullah Khan alleging unprofessional activities by the Supreme Court’s Registry in terms of unequal treatment to him as well as common man in terms of listings.

A three-judge bench of Chief Justice S.A. Bobde, Justices A.S. Bopanna and V. Ramasubramanian heard the plea. Khan charged the Registry of pointing unnecessary defects and alleging discrimination.

According to the petitioner, he had filed a writ petition on February 2016 seeking reconsideration of the judgment in the case of “All India Judges Association Vs. Union of India & Ors (2002)” and amendment to the Maharashtra Judicial Service Rules, 2008. Once the review was dismissed on August 5, a Curative Petition was filed on the same day. After some defects were pointed out by the Registry, the petitioner cured all the defects on the same day. However, even after the removal of the defects and constantly asking the Registry to register the petition, the same was not done.

The petitioner has alleged that his Curative petition was deliberately not scrutinized by Registry for 22 days, and such act is discriminatory and illegal.
