Allahabad High Court gives four months to Mathura court to decide on disability pension payment scam

The Allahabad High Court has directed the Civil Judge, Junior Division Mathura, to decide within four months the criminal case relating to the continuation of pension payments to fake persons in connivance with the authorities, after the death of persons receiving disability pension.

A Single Bench of Justice Rajiv Gupta passed this order on Wednesday, while hearing an application filed by Madhav Singh, under Section 482 CrPC.

The applicant has invoked the jurisdiction of the Court under section 482 Cr.P.C. with a prayer to direct Civil Judge Junior Division F.T.C. Mathura to decide Miscellaneous case, Madhav Singh Vs. Imposter (Onkar Singh) and others, under section 156(3) Cr.P.C. P.S. Magorra District Mathura within the stipulated period.

Dharmendra Singh, Counsel for the applicant has submitted that the application filed by the applicant under section 156(3) is pending since July 23, 2019 and has not yet been decided and has been lingering-on, on one pretext or the other.

“In view of above, the Court expects the Civil Judge Junior Division, Mathura to make all endeavour to conclude the trial of the aforesaid case expeditiously preferably within a period of four months after giving opportunity of hearing to both the sides and without giving unnecessary adjournments to either side and there is no other legal impediment in deciding the case.

With these observations, the application filed under section 482 Cr.P.C. stands disposed of”, the order said.
