Allahabad High Court seeks information from Ghaziabad Development Authority

The Allahabad High Court on Friday sought information from the Ghaziabad Development Authority on a petition against the auction of a flat allotted to an authority employee and asked if it is willing to sell the flat at the prescribed minimum price.

The special bench of Justice Saral Srivastava constituted during the winter vacation has sought this information while hearing the petition filed by Mahendra Kumar Sharma, the authority employee.

The petitioner said he, a Ghaziabad Development Authority employee, was allotted flat number A153 in Karpooripuram Scheme on rent. But later he was allotted flat number A142.

In 2016, it was decided to sell flats to GDA personnel. Under which a notice was issued to auction flats remaining from the sale. Because the flat in which the petitioner is staying is also being auctioned. Auction of two flats has been withdrawn since the people living in it have died. The petitioner said that the auction of his residence should also be stopped.

M.C. Chaturvedi, Senior Counsel for the respondents, contended that flats under the resolution of 2016 have been sold under Shastri Nagar scheme and not under Karpooripuram scheme, therefore, petitioner cannot claim parity since two schemes are totally different.

He contended that it is the domain of the Board to dispose of their property in a manner which is beneficial and fetches higher revenue to the GDA.

The counsel also stated that the petitioner has no locus standi to challenge the auction notice inasmuch as he is only an allottee of flat in question on rent.

During the course of arguments, a proposal has been given by the petitioner’s counsel that the petitioner is ready and wiling to purchase the flat on the minimum reserve price. On this, the GDA advocate asked for time to seek information.

The petition will be heard next on January 4, 2021.
