Delhi riots: Karkardooma Court disappointed on case pendency due to police apathy

A Delhi court expressed its disappointment over the pendency of cases relating to the Delhi riots 2020 since June 22, 2020 and as the court is not able to commit the same to Sessions Court due to non-appearance of Special Public Prosecutor for the state and also due to the lackadaisical attitude of police officials of the concerned crime branch.

The bench of Chief Metropolitan Magistrate Arun Kumar Garg of Karkardooma Court called in explanations from the concerned jail superintendents for non-production of accused Ibrahim and Jalaludin before the court. 

The bench was dealing with a case regarding murder of the Head Constable Rattan Lal and causing head injuries to a DCP during the riots registered at Dayalpur police station.

An explanation was called for by the bench from the IO (Investigating Officer) as well as from the DCP of the Crime Branch for not taking appropriate actions in accordance with the law against them for the non-compliance of directions given by the court. The explanations were called in under signatures of the Special Commissioner of Police.

The Magistrate noted that as per the orders dated November 1, 2021  no acknowledgment was placed on record by the IO concerning the supply of deficient copies to one of the accused. The bench directed the investigating officer to supply the deficient copies to one of the co-accused as well.

The bench further noted that the IO as well as the SPP has not appeared in the court. The bench also allowed one of the accused to receive a pair of shoes from family members in jail. A copy of the said direction was sent to the Jail SP to permit the accused receive shoes from his family as per the rules.

According to the FIR registered at Dayalpur police station on the statement of a constable on February 24, 2020 when the constable was on duty at Chand Bagh area, violent protesters gathered at the main road with iron rods, lathis etc ignoring all the directions of the concerned officers at the duty and attacked ACP Gokulpuri, DCP Shahdara, and Head Constable Rattan Lal and because of that, they fell on the road and suffered grievous injuries. All the persons who suffered grievous  injures were rushed to the hospital, where Head Constable Rattan Lal was declared dead by doctors due to the serious injuries he suffered at the protest spot and the DCP of Shahdara received head injuries and was unconscious when brought to the hospital.

The matter has been listed on January 17, 2022 for further hearing.
