FIR filed after 22 years: Madhya Pradesh High Court dismisses petition

A Single Bench of Justice Rohit  Arya while considering the Petition observed  that “I am afraid indulgence under Article 226 of the Constitution can be sought in obtaining facts and circumstances.”

The Madhya Pradesh High Court on November 29 dismissed a petition filed seeking action against the respondents after 22 years.

The petition has been filed by one Bhairulal Sahu styled himself as “Adatiya” (a shopkeeper who buys and sends goods to customers or moneylenders and sells their goods).

The grievance of the petitioner is that 417 bags of dry coriander leaves were misappropriated in 1999 while kept in a godown in collusion with respondents but now in 2021, the petitioner has filed FIR against certain persons and no action is being taken.

A single-judge bench of Justice Rohit  Arya observed, “I am afraid indulgence under Article 226 of the Constitution can be sought in obtaining facts and circumstances.” The High Court therefore dismissed the petition finding it misconceived.

“Observation on facts is only for the purpose of disposal of this petition,” clarified the Court.
