Gauhati HC issues notice on PIL alleging misuse of funds in 4 Assam universities

The Gauhati High Court recently issued notice on a PIL alleging misuse of the funds of four universities in Assam.

The petitioner, Amguri Naba Nirman Samity, had approached the High Court earlier in a PIL where allegations had been made against officers for misuse of funds at Tezpur University, Assam Agricultural University, Gauhati University and Dibrugarh University.

By an order dated February 3, 2021, the High Court disposed of the PIL by the following order:-

“The allegation of corruption raised by the present petitioner is based upon a report by the Comptroller and Auditor General of India, which the petitioner had obtained under the Right to Information Act, which is also annexed with the writ petition.”

“We do not say anything on the merits of the case but, considering that these are all autonomous bodies, in case there is such allegation, it would be only just and fair if the petitioner first approaches the Chancellor of the concerned Universalities with detailed representations as we expect the Chancellor to take a decision on those representations. In case the grievance of the petitioner is still not met or he is not satisfied with the disposal of the representations, he will be at liberty to come before this Court again.”

Now, the petitioner has approached the High Court again stating that although they have approached the Chancellor on March 22, 2021 but nothing seems to have happened.

While considering the PIL, the Division Bench headed by Chief Justice Sudhanshu Dhulia issued notice to the respondents.
