Madhya Pradesh High Court directs Assistant Forest Conservator’s date of appointment to be corrected within 90 days for seniority list

The Madhya Pradesh High Court has recently directed the forest authorities concerned to consider and decide the petitioner’s representation within a period of 90 days where the petitioner is seeking correction in the date of appointment in the seniority list of State Forest Service Officers.


The single-judge bench of Justice Vishal Mishra deemed it appropriate to dispose of the petition with a direction to the petitioner to file a certified copy of this order before the respondents, who in turn is directed to consider and decide the pending representation within a period of 90 days from the date of receipt of certified copy of the order.


The petition has been filed by one Rajbendra Mishra being aggrieved by the action of the respondents in not correcting his date of appointment in the seniority list of Assistant Conservator of Forest.


S.K. Agrawal, counsel appearing for the petitioner, submitted that the petitioner is a State Forest Officer. The petitioner is presently working as Assistant Conservator of Forest. The petitioner appeared in the State Forest Service Examination, 2010. The petitioner cleared the written examination but he was not invited for the interview on the ground that he has become over age. The respondent did not count the services rendered by the petitioner as Samvida Shala Shikshak while computing the maximum age for appointment as Assistant Conservator of Forest.


Against the said action, the petitioner has approached the High Court by filing a writ petition. The said Petition was allowed vide order dated February 12, 2015. In compliance with the order passed by the High Court the Public Service Commission issued a revised select list for the post of Assistant Conservator of Forest wherein the name of the petitioner .On the basis of the revised select list the State Government issued an order dated July 13, 2015 whereby the petitioner was appointed on the post of Assistant Conservator of Forest.


It is further submitted that despite the petitioner has been assigned seniority on the basis of the select list prepared by the Public Service Commission, his date of appointment in the seniority list is mentioned as July 13, 2015 and the persons below him in the select list are shown to have been appointed on August 16, 2011.

Agrawal, argued further that since the date of appointment of the petitioner which is shown to have been July 13, 2015, petitioner is not being considered for appointment by promotion to the Indian Forest Service on the ground that he has not completed eight years of service as State Service Officer.

The petitioner has preferred a representation seeking correction in the date of appointment in the seniority list of State Forest Service Officer. The said representation was not considered and decided till date. A prayer was made by the petitioner to direct the respondents to consider and decide the representation.
