Allahabad High Court orders Varanasi Police chief to provide police security for conduct of Mahatma Gandhi Kashi Vidyapeeth student union elections

The Allahabad High Court has ordered the Commissioner of Police, Varanasi to provide police force to conduct the Mahatma Gandhi Kashi Vidyapeeth Student Union elections peacefully.

A single-judge bench of Justice Ajit Kumar passed this order while hearing a petition filed by Shashi Prakash Chandan.

Shashi Prakash Rai, Advocate appearing for the University, stated that in view of ongoing Assembly election in the State for the seventh phase in Varanasi, the police is not in a position to provide necessary force to ensure free, fair and peaceful election of the Students’ Union of University although a letter was written to the Commissioner of Police, Varanasi on January 19, 2022.

Rai submitted that soon after the elections are over and notification to that effect is issued by the Election Commission, the University shall again write to the Commissioner of Police, Varanasi within three days thereafter.

“Accordingly, it is hereby provided that the Commissioner of Police, Varanasi shall ensure the availability of necessary police force to ensure the peaceful election of the Students’ Union of the University by writing back to the University within two days thereafter. It is further directed that soon after receipt of letter from Commissioner of Police, as directed hereinabove, the University shall publish the schedule of the election within a week thereafter to hold election of the students union as per the rules prescribed for,” the Court ordered.

With these observations and directions, the Court disposed of the petition.
