Calcutta High Court directs SDO to probe MGNREGA irregularities in Malda

The Calcutta High Court directed the Sub-Divisional Officer, Chanchal Sub-Division Malda to conduct an inquiry and take immediate action against persons responsible for the misappropriation of Rs 1 crore which was allotted for Mission Million Dream i.e. MMD/horticulture work under the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) scheme under Chandrapara Gram Panchayat in Chanchal-II Block, Malda.

During the hearing, the counsel for the petitioners submitted that the petitioners want to withdraw this petition.

The Court noted that the tender for the said scheme was floated by the concerned pradhan and there was an allegation of illegal process in tendering and order for stoppage of work yet the amount was disbursed to the contractor by the pradhan.

Block Development Officer, Chanchal Development Block, Malda had sent the communication dated 11.11.2020 to the pradhan which indicates that the inquiry was in progress in respect of the allegation.

In the aforesaid background the Bench is of the view that once the inquiry was initiated, it should be completed to ascertain the truthfulness of the allegation.

Hence, the Court directed the Sub-Divisional Officer, Chanchal Sub-Division Malda to duly look into the allegation and conduct an enquiry in accordance with law after giving an opportunity of hearing to all the concerned parties and in case, if any irregularity in the process is found, then to take immediate action against the persons responsible for the same.

Let this exercise be completed within a period of three months from the date of receipt of a copy of this order, directed the Court while dismissing the PIL.
