Uttarakhand High Court dismisses PIL against unauthorized construction on Nazul land

The Uttarakhand High Court has dismissed a Public Interest Litigation (PIL) alleging that some persons are unauthorizedly constructing on Nazul land.

The PIL has been filed by Ravi Shankar Joshi.

Rajeev Singh Bisht, the counsel for the petitioner, submitted that the names of the persons have not been supplied to the petitioner by the authority in his application filed under the Right to Information Act, 2005.

The Division Bench of Justice S.K. Mishra and Justice R.C. Khulbe while perusing the RTI application noted that in spite of providing the names of the persons to the petitioner, he has not arrayed them as party respondents.

Hence, the Bench is not inclined to entertain this petition. The writ petition is dismissed being devoid of any merit.
