Punjab and Haryana HC disposes of PIL against encroachments, illegal constructions in Barnala district

The Punjab and Haryana High Court recently disposed of a PIL filed against rampant encroachments and illegal construction on public property/roads in Municipal Council, Dhanaula, District Barnala.

The PIL, filed by one Sukhchain Singh, submitted that the petitioner has filed a representation with regard to his concerns/grievances, the latest one being dated 28.06.2021, before the respondent-authorities but no response has been received nor has any action been taken by the respondent-authorities so far.

Avinit Avasthi, Assistant Advocate General, apprised the Court that the representation filed by the petitioner shall be considered and decided and necessary action, if warranted, would be taken by the authorities in accordance with law expeditiously.

The Division Bench of Chief Justice Ravi Shanker Jha and Justice Arun Palli in view of the statement made by the  Assistant Advocate General, Punjab, disposed of the PIL.

“However, it is made clear that this Court has not expressed any opinion on the merits of the case and therefore, the authorities would be at liberty to examine the matter keeping all facts and facets into consideration and thereafter accept or reject the same in accordance with law,”
