Punjab and Haryana HC disposes of PIL against inaction in stopping unauthorized construction in Ambala

The Punjab and Haryana High Court on Tuesday disposed of a PIL alleging inaction on the part of respondent authorities in stopping illegal and unauthorized construction within the municipal limits of Ambala City.

The PIL has been filed by one Deepak Sharma. Jagmohan Singh Bhatti, the counsel for the petitioner, submitted the respondent authorities have taken cognizance of the complaint dated July 10, 2021 made by the petitioner and vide their reply dated September 2, 2021 informed that the illegal construction being undertaken at Palika Vihar, Ambala City has been ordered to be sealed. However, in spite of the said orders, the illegal construction is continuing.

Bhatti further submitted that the petitioner has filed representations dated 21.09.2021  and 26.10.2021 which may be considered by the respondent authorities and appropriate action in accordance with law be taken thereon.

Deepak Balyan, Additional Advocate General, Haryana, on an advance copy, asserted that the respondent-authorities are already seized of the matter and would look into the representations of the petitioner and take action thereon expeditiously in accordance with law, including ensuring compliance of the orders passed by the respondent-authorities regarding sealing and stopping the illegal construction.

In view of the aforesaid statement made by the State counsel, the Division Bench of Chief Justice Ravi Shanker Jha and Justice Arun Palli did not find any reason to entertain the PIL which was accordingly disposed of.

“It is made clear that this Court has not expressed any opinion on the merits of the case and, therefore, the authorities would be at liberty to examine the matter keeping all facts and facets into consideration and thereafter accept or reject the same in accordance with law,”
