Uttarakhand High Court issues notice on PIL seeking local bodies elections on the basis of existing un-revised electoral rolls

The Uttarakhand High Court issued notice on a Public Interest Litigation (PIL) seeking a direction to the respondents to conduct the local bodies / municipal elections on the basis of existing un-revised electoral rolls along with pre-existing constituencies, and to issue election notification for conduct of elections of municipalities, including Nagar Palika Parishad, Jaspur, whose term is to expire on 02.12.2023.

The petitioner also seeks direction to the State Election Commission, Uttarakhand, to carry out its legal obligations under Article 243-U of the Constitution of India. Other consequential reliefs have also been sought.

The Division Bench of Chief Justice Vipin Sanghi and Justice Rakesh Thapliyal issued notice to the respondents and directed the respondents to file their counter-affidavits positively within two weeks.

“In case, the respondents have not yet initiated the requisite processes for the purpose of revision of electoral rolls and delimitation, the same should be initiated without waiting for any further orders, and status reported”, directed the High Court .

The Court listed the matter on 01.11.2023 for further hearing
