Supreme Court grants bail to man accused in dowry death of his wife

On Friday last, the Apex Court bench of Justices Hemant Gupta and Justice Aniruddha Bose noted that Anil Kumar has been languishing in judicial custody since November 5, 2014, as submitted by Anushri, the petitioner’s counsel. For the state, Vishnu Shankar Jain appeared.

On Tuesday, the bench issued notice to the state, wherein the Petitioner has been implicated in case of dowry demand and dowry death. He got arrested for the offense under IPC Sections 498a, 304 b, and provisions of the Dowry Prohibition Act. The High Court of Allahabad had declined to allow bail considering the nature and seriousness of the offense.

Perusing Anil Kumar’s second bail application, the High Court noted the fact this Court directed the trial court to conclude the trial within 6 months in the first bail application moved by him.

The state’s counsel opposed the regular bail petition and argued that in the dying declaration, the deceased had taken the name of Anil Kumar, and hence under any circumstances, the petitioner cannot be released on bail. The single judge again passed directions for the trial court to conclude the trial within a period of 6 months.
